Gold IRA Metals at Home: Custody Rules & McNulty Case
Do not use a home safe as the custody arrangement for IRA-owned gold. The IRS says eligible bullion must be physically possessed by a bank or IRS-approved nonbank trustee, including when an IRA-owned LLC purchases the bullion. Certain coins have a separate collectibles exception, but that does not authorize the IRA owner’s unrestricted personal possession.9, 16
The distinction matters: an LLC, an eligible coin and a qualified custodian are different things. Calling a structure “checkbook control” does not answer who may possess IRA assets or how they are reported.

The Bullion Rule and the Coin Exception
Section 408(m) generally treats an IRA’s acquisition of a collectible as a distribution of the amount invested. It then excepts certain listed coins and qualifying bullion. The bullion paragraph ties fineness to a contract-market standard and requires physical possession by the trustee described in section 408(a).16
For gold bullion, the captured CME contract rule requires 0.995 fineness; do not substitute the 0.9995 figure associated with other metals. A qualifying American Eagle coin has a separate statutory route. Product eligibility is still not permission to take the coin home while treating it as held in the IRA.17, 16, 36
| Claim you may hear | What the evidence actually establishes |
|---|---|
| “An IRA-owned LLC can hold bullion wherever its manager wants.” | The IRS explicitly applies qualified trustee possession to an LLC’s indirect bullion acquisition.9 |
| “American Eagle coins are exempt, so personal custody is allowed.” | The McNulty court rejected that argument under the basic IRA fiduciary/custody requirements.36 |
| “A home safe with separate labels replaces a trustee.” | Labels do not establish the qualified trustee administration required by section 408.16 |
| “Personal possession always creates every possible penalty at once.” | Distribution, collectible and prohibited-transaction rules have different triggers; do not stack them indiscriminately.10 |
What McNulty Actually Decided on November 18, 2021
In McNulty v. Commissioner, 157 T.C. No. 10, Donna McNulty directed her self-directed IRA to invest in an LLC and used that structure to purchase American Eagle coins. She took personal possession of the coins. The Tax Court held that her receipt of the coins was a taxable distribution, notwithstanding her role as LLC manager. It also sustained accuracy-related penalties for substantial income-tax understatements.36
The linked source is the court opinion PDF hosted by Groom Law Group, not a dealer’s summary. The opinion discusses separate facts for Andrew McNulty, including conceded prohibited transactions. Those facts should not be collapsed into a claim that every home-delivered coin automatically produces the same whole-account consequence or the same tax bill.36
The important lesson is narrower and stronger than “the IRS wins every case”: the actual case rejected an eligible-coin/LLC argument where the owner had unfettered control over the coins. It does not support made-up enforcement statistics, a universal audit probability or an invented list of all court challenges.
Different Tax Problems Have Different Consequences
| Situation | General rule and qualification |
|---|---|
| IRA buys an ineligible collectible | The amount invested is generally considered distributed in the year invested, not automatically every other asset in the IRA.10 |
| Owner or beneficiary engages in a prohibited transaction | The affected account generally stops being an IRA as of the first day of that year and is treated as distributing its assets.14 |
| Owner receives an IRA distribution | Traditional-IRA taxation depends on taxable amounts and basis; early-distribution additional tax can have exceptions. Qualified Roth distributions follow different rules.10 |
| Another disqualified person engages in a prohibited transaction | Excise-tax rules for that person are distinct; they should not be mechanically added to the owner’s account-loss example.10 |
An actual tax analysis needs the account type, acquisition and receipt dates, values, prior basis, documents, age and applicable exceptions. This guide does not diagnose an existing arrangement. A custodian’s administrative acceptance is not independent legal advice; Investor.gov says self-directed custodians do not evaluate the quality or legitimacy of the investment or promoter.13
Hypothetical distribution math, not a penalty forecast
Assume a tax professional determines that $50,000 is fully taxable as a traditional IRA distribution, uses an illustrative flat 24% federal rate and concludes the 10% early-distribution additional tax applies without an exception. The simple amounts are $12,000 income tax and $5,000 additional tax, or $17,000 combined. State tax, marginal-bracket changes and other facts are excluded.
This is not a McNulty tax reconstruction or a claim that every home-storage arrangement owes that amount. It deliberately does not add owner-prohibited-transaction account loss and another person’s excise taxes to the same dollars. The IRS distribution guidance is the starting point for the applicable tax categories.10
What Legitimate Vault Custody Looks Like
IRA owner gives investment instructions
↓
Qualified custodian administers the IRA
↓
Dealer delivers approved products under the custody arrangement
↓
Depository records holdings; custodian authorizes later movement
Delaware says its IRA holdings are controlled by the trustee/custodian and that reports and instructions go through that party. IDS’s IRA inspection, pickup and delivery procedure requires custodian authorization. An approved inspection is not the same as permission to take the metal home without distribution treatment.20, 23
Use storage options explained to review inventory, title and insurance records. The segregated/commingled comparison explains why customer-separated storage is a contract choice, not a way to create personal custody.
Already Have IRA-Purchased Metals at Home?
Do not assume moving the metal into a vault now reverses an earlier distribution or cures a prohibited transaction. Get independent advice before shipping, selling, changing ownership or filing amended returns. The possible tax consequences turn on the actual history, not the location on the day you seek help.10, 14
Prepare a chronology for a qualified tax professional or attorney:
- The IRA type and custodian agreement.
- The funding method, transfer/rollover dates and any payment to you.
- LLC formation/ownership documents and who could direct its bank account.
- Purchase invoices, payment sources, delivery dates and custody records.
- The exact items, values and any sale or personal use.
- Returns, Forms 1099-R/5498, notices and prior professional advice.
Ask which rule applies and which filings or corrective actions are appropriate. Do not choose a disclosure program or amendment strategy from a generic web checklist. A dealer arranging a new sale cannot determine whether old tax consequences disappear.
Personal Gold Outside an IRA Is a Different Purchase
You may buy personally owned gold with non-IRA funds and arrange storage separately. You may also discuss a documented in-kind IRA distribution with your custodian; its taxable treatment depends on the account and your facts. Once metal is distributed to you, it is not still held under the IRA’s custody arrangement merely because the original invoice names an IRA.10
The comparison is not “free home storage” versus “expensive vault rent.” Personal security and insurance cost money too, but no universal home-insurance or safe price is established here. Obtain an actual policy and quote instead of using fear-based estimates.
Frequently Asked Questions
Does the LLC exception solve the bullion possession issue?
No. The IRS explicitly says its qualified-possession rule applies to IRA-owned LLC purchases of bullion.9
Do eligible coins make home storage safe?
No owner-possession workaround is established. The actual McNulty opinion addresses American Eagle coins and rejects personal receipt/control through the LLC structure.36
Are all IRA distributions taxed the same way?
No. Traditional IRA basis, early-distribution exceptions and qualified Roth rules matter. Avoid categorical statements that every dollar is ordinary income plus a penalty.10
What is the practical next step before opening an account?
Identify the qualified custodian and storage agreement before buying. Use the precious-metals IRA overview, fee definitions and current provider fee comparison to compare compliant account arrangements rather than an owner-custody sales pitch.
