401(k) to Gold IRA: Eligibility and Rollover Checklist
A 401(k) can fund a Gold IRA only when your plan permits a distribution and that payment is eligible for rollover. An eligible pre-tax direct rollover to a traditional IRA generally preserves tax deferral; moving pre-tax money to a Roth IRA is a taxable conversion. The dealer cannot override your employer plan’s eligibility rules.9
This guide is the 401(k)-specific document and execution checklist—not an argument for replacing your retirement portfolio with gold. The asset decision and account-movement decision should be evaluated separately.

Start With the Source Plan, Not a Metal Order
Leaving employment can create access to a distribution, but it does not mean every dollar or payment form is rollover-eligible. An active employee needs the plan’s specific in-service provisions. Different contribution sources can have different restrictions. Ask the administrator to identify the rule for your elective deferrals, employer contributions, prior roll-in money, designated Roth balance and after-tax basis.9
| Item on the statement | Question for the administrator | Why it changes the request |
|---|---|---|
| Pre-tax vested balance | What amount is distributable now? | A statement balance is not necessarily the amount available to roll over |
| Designated Roth balance | Can it be sent separately to a Roth IRA? | Roth and pre-tax dollars require appropriate destinations |
| After-tax contributions | What basis and earnings breakdown accompanies the payment? | Basis is not the same as pre-tax income |
| Unvested employer contributions | Which amounts are vested on the distribution date? | Do not budget a rollover using forfeitable money |
| Loan balance | Is this repayment, deemed distribution or a qualified loan offset? | The tax treatment and replacement deadline can differ |
| RMD or hardship payment | Is any requested payment excluded from rollover? | A receiving custodian’s acceptance cannot change legal eligibility |
The IRS rollover guidance supplies the excluded-payment framework; the source plan supplies the amount and payment options. Request the summary plan description, distribution election package and applicable rollover notice. Do not quit employment, repay a loan or place a metal order solely because a salesperson says a rollover requires it.
The 401(k) Execution Sequence
Eligibility, vested sources and payment election
Account acceptance and direct-rollover receipt
Separate metal order and custody confirmation
- Confirm distribution eligibility. Get the administrator’s answer in writing, including any in-service provision.
- Separate source tax types. Record pre-tax, designated Roth and after-tax amounts; match each to a permitted destination.9
- Open and identify the receiving IRA. Confirm the legal trustee and account title, not just the dealer’s brand.
- Submit the plan’s direct-rollover election. Check payee, account number, gross eligible amount and any excluded payment.
- Track the payment. Keep release confirmation and the receiving trustee’s posted receipt. Do not assume mailed means deposited.
- Give the investment instruction separately. Approve exact products and written costs only after account funding/acceptance is established.
- Reconcile the records. Match the plan payment to the IRA receipt, metal invoice and storage inventory; later compare tax forms.10
This is a sequence, not a promised seven-day or six-week timetable. The 401(k) timing guide explains how to get stage-specific status without inventing processing averages.
Outstanding Loans Require Their Own Decision
IRS Publication 575 distinguishes a deemed loan distribution from a plan-loan offset. A qualified offset caused by plan termination or severance can have a replacement-rollover deadline extending to the tax-return due date, including extensions. That is not permission to give every loan or delayed distribution the same extended deadline.15
Ask which event has actually occurred, what Form 1099-R coding applies, whether repayment is still possible under the plan and which deadline the administrator identifies. Do not assume the receiving metals IRA can simply accept the outstanding debt as if it were cash.
A Withholding Example Without a Return Forecast
Assume an entirely pre-tax, eligible $50,000 plan distribution. A direct rollover of the full amount to a traditional IRA generally has no participant-payment withholding. If paid to you, mandatory 20% federal withholding generally leaves $40,000, with $10,000 withheld. Rolling over only $40,000 generally leaves the $10,000 not rolled over potentially taxable; completing a $50,000 rollover requires replacing that withheld amount within the applicable deadline.9
This example excludes basis, excluded distributions, state rules and relief. It does not recommend borrowing the replacement money. Withholding is credited on the tax return; whether there is a refund depends on the whole return.
Before Giving Up Plan-Specific Access
At ages 55–59½, ask whether separation-from-service access avoids the additional 10% tax under an employer-plan exception. That exception does not follow money into an IRA. A tax-deferred rollover can therefore change the rules on a later withdrawal even if it does not create current income.11
Also identify whether employer stock, plan loans, spouse consent or a retirement-benefits court order requires a separate review. A partial request is only an option if the plan allows the relevant payment; it is not a universal percentage strategy.
Identify the Transaction Before Filling In Forms
The IRS distinguishes an IRA trustee-to-trustee transfer from an employer-plan direct rollover and from a distribution paid to you. These are not interchangeable names for the same paperwork. Buying gold is a later investment instruction, not itself the rollover.9
| Source and delivery | Receiving account | Deadline, withholding and frequency distinction |
|---|---|---|
| Traditional IRA trustee pays another traditional IRA trustee | Same-type IRA | No participant 60-day rollover clock; IRA one-per-year restriction does not apply |
| Eligible pre-tax employer-plan distribution paid directly to the IRA trustee | Traditional IRA | A reportable direct rollover; participant-payment 20% withholding generally avoided |
| Eligible employer-plan distribution paid to you | Eligible receiving IRA | Generally 60 days; taxable eligible payment generally has mandatory 20% withholding; not subject to the IRA-to-IRA one-per-year rule |
| IRA distribution paid to you and redeposited | Eligible same-type IRA | Generally 60 days; IRA withholding generally defaults to 10%, usually changeable or waivable; one indirect IRA-to-IRA rollover across your IRAs per rolling 12 months |
| Pre-tax balance moves into Roth | Roth IRA | Taxable conversion of the pre-tax portion; using a direct method does not make conversion tax disappear |
The table summarizes IRS rollover guidance and the April 2026 TSP tax booklet for withholding distinctions. RMDs, hardship distributions and certain periodic payments are not eligible rollover distributions. A deadline waiver cannot make an otherwise ineligible distribution eligible.9, 44
For a broader explanation covering different starting accounts, use the Gold IRA rollover guide. For the receiving institution, confirm the legal account title, trustee, account number and acceptable payment instructions before the sending institution releases funds. A check can sometimes be delivered through you while still being payable to the receiving trustee; payee and instructions matter more than the envelope’s address.9
Keep gross distribution, withholding and deposited amount as separate records. Withholding is a tax prepayment, not a provider charge or a final tax assessment. Do not assume it will all be refunded: the return reconciles it with your full-year tax liability.9, 44
Save Records for Reporting, Not Just for Tracking the Shipment
An employer-plan direct rollover is still a distribution from the source plan and can generate Form 1099-R even when its taxable amount is zero. The receiving IRA’s Form 5498 can report a rollover contribution. A same-type traditional IRA trustee-to-trustee transfer, with no payment to the owner, generally is not reported as a distribution on Form 1099-R and is not a transfer contribution reported on Form 5498. Annual fair-market-value and RMD-related Form 5498 reporting can still apply.10
Roth conversions, designated Roth plan rollovers and special SIMPLE IRA rules need their own treatment; do not copy one distribution code onto every transaction. Compare the forms with the actual source, destination and taxable basis. Form instructions for 2026 are the authority for that year’s reporting layout.10
Retain the sending statement, payment confirmation, receiving-account receipt, rollover/transfer designation, and any withholding statement. Add Form 8606 history where after-tax IRA basis matters. If the institution’s records do not match the movement you authorized, request an explanation or correction before filing rather than treating a provider’s “tax-free” label as sufficient evidence.
Receiving Metals: Eligibility and Custody Are Separate Checks
For bullion, section 408(m) ties the exception to the contract-market minimum fineness and the physical possession of a bank or IRS-approved nonbank trustee. CME’s contract rules specify gold at 0.995 and silver at 0.999.51, 64, 65 Platinum and palladium each use 0.9995 in their respective contract chapters. The gold minimum is not 0.9995.66, 67
Specifically enumerated coins have a separate statutory exception; fineness alone is not a complete product approval list. Have the receiving custodian confirm the exact product, mint/refiner, denomination and acceptable documentation before an order is placed. The eligible-metals guide explains both statutory routes.51
The IRS IRA FAQs say the trustee-possession requirement for highly refined bullion also applies when an IRA-owned LLC buys it. Forming an LLC does not establish a home-storage safe harbor. Arrange custodian-authorized delivery to the selected storage facility, not personal delivery while claiming the metal remains inside the IRA.7
Keep the trade confirmation, invoice, storage selection, receipt and inventory record together. Those documents establish the chain from IRA cash to the actual product received. Insurance language should be read with the applicable policy and agreement; it is not protection against falling metal prices or proof of a guaranteed resale bid.
Separate Account Charges From the Metal Quote
The dealer supplies a product quote, the custodian administers the IRA, and the depository holds metal under its agreement. The SEC’s self-directed IRA warning explains that custodians generally do not evaluate an investment’s quality or legitimacy. A custodian accepting a purchase is not an endorsement of its price or suitability.40
Ask for one written worksheet covering setup, custody, selected storage, wires, transactions, sale, transfer, distribution and closure. Specify whether fees are paid from IRA cash or separately, when recurring billing starts, and whether a waiver expires. An undisclosed amount is unknown, not zero. Compare the same product and quantity, with a purchase quote and a same-time executable dealer bid; the bid is not assumed to equal spot.
Our fee definitions and cost arithmetic explain billing and denominators; the dated provider fee comparison distinguishes published schedules, examples and conflicting disclosures. Neither the IRS rollover rules nor a tax-free movement guarantees a cost-free account.
For illustration only, a hypothetical $50 setup, $30 initial wire and $235 annual custody-plus-storage charge total $315 in the first full year and $1,255 over five full years if the schedule stays unchanged. That excludes product-price differences, extra activity, exit charges, taxes and returns. It is not an industry average or any provider’s all-in quote. If the purchase costs $52,500 and the same-day bid is $49,000, the separate $3,500 purchase-to-bid gap is 6.67% of the purchase price, not 7%; the denominator matters.
A useful next step is to obtain the itemized account schedule and exact-product bid before signing an irreversible order. The CFTC/FINRA advisory identifies inflated pricing and pressure tactics as precious-metals red flags; a deadline created by a salesperson is not an IRS deadline.39
Frequently Asked Questions
Is a 401(k) direct rollover a trustee-to-trustee IRA transfer?
No. It is a plan distribution rolled into the receiving IRA and can be reportable even when tax-deferred. A same-type IRA transfer has different reporting.IRS retirement-plan and IRA rollover rules, IRS Forms 1099-R and 5498 instructions (2026)
Must I buy the gold within 60 days?
The indirect rollover deadline concerns receipt of eligible funds in the retirement account. The metal purchase is a separate instruction; it is not the event that proves the rollover deposit.IRS Publication 590-A (2025), IRS retirement-plan and IRA rollover rules
Can a dealer guarantee my active 401(k) is eligible?
No. Get the plan administrator’s distribution determination before opening an account or committing to an order. An IRA provider cannot change the source plan rules.
